第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。) e1 X6 p7 [2 P$ e1 @, W
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。6 N+ }' j$ P9 _' P3 o; u3 k' l% p8 A4 |
第三条 中华人民共和国不承认中国公民具有双重国籍。' X: T. x* d. V; S% O# b
第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。4 ^) a2 o. L# d. E( G
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
) M( U! ^ q1 u7 x8 V9 A$ m* f P$ Z 第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。
9 A1 L$ w7 d, P( O 第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
' \" X$ D' ]1 A6 B8 t+ f3 J 一、中国人的近亲属;2 Y7 _7 ~+ u% x: u, E
二、定居在中国的;

第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。
5 V* W, ? x; Q; H 第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。( B `6 [, _, H! E* ]- r1 q/ }- g' G
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:8 U0 Z2 u0 }& k% i
一、外国人的近亲属;

三、有其它正当理由。
) d5 B% z; I. x- k 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。' X; W. M1 z( {* |7 [
第十二条 国家工作人员和现役军人,不得退出中国国籍。
7 a+ g2 @1 S* v/ @ 第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。; K- s) G+ t" J+ w, o4 f& p
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。, N3 o6 s( I/ X! g0 \9 a7 ~
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
Y. l) e: P% m5 d* Y& q; j 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。

第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of* K/ G5 O; R5 U8 T, C- D
nationality of the People''s Republic of China.* h6 E' q6 v: y3 G) S
Article 2' q5 y4 y2 J- P( I0 O3 l. W
The People''s Republic of China is a unitary multinational state; persons
6 ]5 z0 R: _! I. j8 d2 X4 |- S6 f. }belonging to any of the nationalities in China shall have Chinese7 j/ a( i# U- f3 s7 I7 _

The People''s Republic of China does not recognize dual nationality for any3 o) @7 `2 R, Y. I4 E# c

Any person born in China whose parents are both Chinese nationals or one+ M! ~( Q' i- b$ f
of whose parents is a Chinese national shall have Chinese nationality. C. W9 a0 B/ r5 Y: l
Article 5
8 i0 E' A4 R# R, M$ U! fAny person born abroad whose parents are both Chinese nationals or one of2 ~( r3 s/ ^: A9 \% v/ i- ~, g
whose parents is a Chinese national shall have Chinese nationality. But a5 V7 K3 r* m& g, p7 x: o
person whose parents are both Chinese nationals and have both settled$ o# V" t6 ~0 |: o/ f% q& S/ S
abroad, or one of whose parents is a Chinese national and has settled: l/ G6 }0 \9 }. V& h% s
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain/ {" e, e8 D! D+ M; ]/ n

Article 7
@0 V9 r* M! f2 I9 A$ OForeign nationals or stateless persons who are willing to abide by China''s6 }: d( t$ L8 ~, J5 U& x( p
Constitution and laws and who meet one of the following conditions may be* I& x) [( q3 B1 T0 Y, N
naturalized upon approval of their applications:
9 b! p. n; }( g. f% S1 G; M(1) they are near relatives of Chinese nationals;
# b; k e, s7 g4 Z. A# `2 P6 @0 k(2) they have settled in China; or" w! g/ }2 U! C: j
(3) they have other legitimate reasons.; t# v( b* P) S2 g p
Article 8; l3 m- ?1 T; d) W
Any person who applies for naturalization as a Chinese national shall
' g4 G ~9 [) j( r) J; Hacquire Chinese nationality upon approval of his application; a person3 n6 \/ R7 r+ F6 e
whose application for naturalization as a Chinese national has been6 e1 e" z% J, x' C5 w [9 `6 @, I7 v
approved shall not retain foreign nationality.
7 p9 i7 o2 P# AArticle 9
' t7 i6 X2 I0 h( ], e$ QAny Chinese national who has settled abroad and who has been naturalized" [ G" M3 H; ^( O
as a foreign national or has acquired foreign nationality of his own free }/ k- p) h' u
will shall automatically lose Chinese nationality. {) m/ X% S4 u" p5 Z
Article 10! C# ] P/ F P; ~2 u
Chinese nationals who meet one of the following conditions may renounce9 d, D# i2 }9 D: X$ }7 }
Chinese nationality upon approval of their applications:
$ {/ w s! G9 Q l, ^- d, i(1) they are near relatives of foreign nationals;
# m; `: b5 K" L" }. l+ \4 s(2) they have settled abroad; or' c# m2 W) Z0 F9 h
(3) they have other legitimate reasons.! H& Y# e. `% R
Article 119 j( } x* {" w/ K9 \
Any person who applies for renunciation of Chinese nationality shall lose
, K5 y+ m/ V6 P0 {4 C, m1 g6 [2 nChinese nationality upon approval of his application.3 r5 c: O) p6 C0 f/ ~) a" V7 C# i3 Y/ e
Article 12
, c4 F7 L4 c; EState functionaries and military personnel on active service shall not
; K/ g" n7 b& `: [: h' Q" h' Rrenounce Chinese nationality.
5 {; }# r) ]( A/ Y) E2 YArticle 13
1 m- `" }9 ~, UForeign nationals who once held Chinese nationality may apply for( |2 v; ?5 G, Q3 T! o- Z
restoration of Chinese nationality if they have legitimate reasons; those
* Y4 P, t3 i- A+ O9 g1 p# s6 fwhose applications for restoration of Chinese nationality have been
" Y2 I4 L7 [9 G, ^: D& Qapproved shall not retain foreign nationality.
4 y& w7 i* f- I7 lArticle 14
% H; w- v1 X8 y$ @/ A" Q4 fPersons who wish to acquire, renounce or restore Chinese nationality, with: E _% Z7 r; V/ _5 O
the exception of the cases provided for in Article 9, shall go through the
3 e; H) y; V5 B/ m2 a7 o7 hformalities of application. Applications of persons under the age of 18. n, ^4 i/ {+ l5 f+ m+ |
may be filed on their behalf by their parents or other legal8 J- x; z# g2 U, `" X2 I
representatives.- x# w# u3 k' B3 Y/ G( u3 q2 [
Article 15" q* O: E/ L9 D* \9 I2 l2 ]5 {% n
Nationality applications at home shall be handled by the public security- f( C0 h: v/ Z
bureaus of the municipalities or counties where the applicants reside;
7 K. W& W, l) P* A. d" ~! pnationality applications abroad shall be handled by China''s diplomatic/ L( u+ X) p( h! a
representative agencies and consular offices.
0 B* L/ s" K6 t9 z, t. a8 K0 V% oArticle 16
* R% m% l; B4 j* t; H# @1 Z: rApplications for naturalization as Chinese nationals and for renunciation
% V) o2 K/ H5 d/ L8 H; c; ^or restoration of Chinese nationality are subject to examination and
0 l1 T0 v4 C1 ]& w# zapproval by the Ministry of Public Security of the People''s Republic of
" |/ S$ Z9 ?1 W% _: I6 M9 zChina. The Ministry of Public Security shall issue a certificate to any: o( I. F/ N2 H J4 t6 k2 ^1 z, {
person whose application has been approved.0 u# R9 V( r7 X! M/ l0 a; ^% y
Article 17
8 t, L# q4 ^! \6 j# w0 B/ N( P& SThe nationality status of persons who have acquired or lost Chinese
- s* ?: F$ p. @! v9 Hnationality before the promulgation of this Law shall remain valid. d& P2 e+ N2 L1 _- X/ c5 Q( i
Article 18& t0 P. |( A ` M1 j1 M2 v
This Law shall come into force on the day of its promulgation. |
